Welcome to Envite!

Bringing friends together through events is at the core of what we do. We're all about building a platform that lets you plan, manage, and enjoy your social events with your pals in a fun, authentic way.

To ensure this, we want to clarify what being part of the Envite family means. We want you to understand what you can anticipate from us, what we hope to see from you, and how we can collectively make Envite an even better space for you and your friends.

To do this, we've put together these Terms of Service ("Terms"), our Privacy Policy, and Community Standards (collectively referred to as the "User Agreement"). Certain words throughout the User Agreement carry specific meanings and should be interpreted consistently wherever they appear. If anything seems unclear or confusing, don't hesitate to get in touch. We're committed to ensuring complete transparency and understanding about how Envite operates.

If you think reading all this is tough, try writing it! But we wrote it for your sake because it's crucial to both you and us. So, please take a moment to read through.

If you choose not to read or agree to the User Agreement, please refrain from using our Services. But if you decide to use our Services, be aware that you're agreeing to be bound by the User Agreement.

Initial housekeeping

  • Envite is owned and operated by Ozone Team, any reference to Envite as an entity (excluding references to the individual Services, Mobile Application or Website) correlates to Ozone Team as an entity in it’s full capacity.

1. Who can use our Services

Our Services refers to all aspects of the Envite mobile applications, our website (https://envite.social/) and the software and systems that power the applications and our website.

As impressive as AI and bots like ChatGPT are, our Services are exclusively for REAL humans (because emotions count,):

  • who are at least 13 years old. Depending on your location, if you're under the age of consent in your country, a parent or guardian may also need to provide consent for you to use our Services; or

  • who have the legal authority to create an account on behalf of another individual, company, organization, government, or other legal entity if you're not creating an account for yourself.

  • in the case that you are a robot, "beep boop boop beep beep boop 🤖"

All references to "you" and "your" in the User Agreement refer to you, the end user, and/or, for accounts created on behalf of another individual, company, organization, government, or other legal entity, the individual with the legal authority to create and/or operate the account.

2. Data Protection and Privacy

Our Privacy Policy outlines what information you share with us, when it is shared, and how we handle it when you use our Services. By using our Services, you consent to us collecting, using, storing, processing, sharing, and transferring this information to countries where we operate our Services and to partners who assist us in providing our Services.

3. Content

Everyone appreciates authenticity, kindness, and respect. Don't be the person who steals Content or disrespects others. Be genuine. Be considerate. Be yourself. Be Envite.

Content refers to profile events, photos, videos, emojis, locations, reactions, or messages shared through our Services.

You are responsible for the Content you share through our Services. This includes ensuring you have the right to use the Content and that it complies with laws, rules, regulations, and the User Agreement.

If you share Content that you don't have the right to use or that violates laws, rules, regulations, or the User Agreement, we have the right to remove it, and we will. No exceptions.

We don't tolerate harassment, intimidation, defamation, threats, hate speech, child sexual exploitation, sexual abuse, promotion of suicide or self-harm, intellectual property theft, or other illegal activities. For more details, refer to our Community Standards, which form part of the User Agreement.

You own the Content you share through our Services and grant Envite a license to use the Content under the following conditions:

  • Friends Only Content refers to Content you've shared exclusively with your friends on Envite. Voluntarily, some users might choose to share their Friends Only Content with Envite for communication, commercial, and marketing purposes—such as for billboards, other advertising, Apple's App Store, or Google's Play Store. If you choose to do so, you'll need to provide Envite a license to use your Friends Only Content.

  • Publicly Shared Content means Content you've shared with everyone on Envite. In exchange for using our Services, you grant us a global, non-exclusive, royalty-free, sublicensable license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute the Content you share as Publicly Shared Content across all media or distribution methods. This license permits us to make your Publicly Shared Content accessible to the rest of the world and to permit others to do the same. You agree that this license includes the right for Envite to provide, promote, and improve our Services and to make Publicly Shared Content available to other companies, organizations, or individuals for syndication, broadcast, distribution, promotion, or publication on other media and services. Any additional uses by Envite, or other companies, organizations, or individuals are carried out with no compensation paid to you regarding the Publicly Shared Content, as the use of our Services by you is agreed upon as being sufficient compensation.

4. Reporting Violative Content

We're under no obligation to monitor the Content shared through our Services. However, we strive for our Services to be a place where people can have fun, express their authentic selves, and feel safe. Content that violates another person's rights or doesn't comply with laws, rules, regulations, or the User Agreement ("Violative Content") is not allowed. If you come across Violative Content, you can report it to us via the reporting feature in the applications or by visiting the reporting form on our website.

If you believe your Content has been copied in a way that infringes on your intellectual property rights, you can report this directly in the application or by visiting our intellectual property reporting form on our website.

5. Ending our Services

We may temporarily or permanently suspend your account and prevent your use of our Services if we find that you have shared Violative Content or used our Services in a manner that infringes on another person's rights or doesn't comply with laws, rules, regulations, or the User Agreement.

We operate a 3 strike policy in most instances. That means if you share Violative Content, we'll suspend your account for 30 days, during which you won't be able to share Content or view other Content on our Services. If this happens 3 times, we'll have to bid you farewell. We'll permanently suspend you from our Services and prevent you from creating a new Envite account.

Note that certain Violative Content (e.g., Child Sexual Abuse Material (CSAM)) will result in your immediate and permanent suspension from our Services.

You may appeal a suspension by contacting us through our support form.

To safeguard you, other users, and our Services, we may temporarily suspend your account if we detect unusual activity that could present technical or security risks to you, other users, or our Services.

We'll delete your account if it's inactive for more than 2 years. But before we do, we'll inform you, so you can halt the deletion if you wish.

We understand that sometimes things just don't work out. You can delete your account at any time by going to the settings in your account and choosing the account deletion option.

6. License to use our Services

Our Services are protected by copyright, trademark, trade secret, and other laws worldwide. As appealing as it may be, nothing in the User Agreement grants you a right to use the Envite name or any of the Envite trademarks, logos, domain names, distinctive brand features, and other proprietary rights.

During your usage of our Services, Envite grants you a personal, global, royalty-free, non-assignable, and non-exclusive license to use the software provided as part of our Services. This license is solely to enable you to use and enjoy our Services in a manner consistent with the User Agreement. This license ends when you stop using our Services.

Envite is free to use any feedback, comments, or suggestions you provide regarding our Services.

7. Limitation of Liability

By using our Services, you agree that Envite, its affiliates, related companies, officers, directors, employees, agents representatives, partners, and licensors' liability is limited to the maximum extent permissible in your country of residence.

8. Applicable law and jurisdiction

To the extent that these Terms permit you or Ozone Team to initiate litigation in a court, both you and Envite consent to the exclusive jurisdiction of the Western Australia courts and Australian law. You and Envite agree that all claims and disputes (contractual or otherwise), arising out of or relating to the Terms or User Agreement, will be litigated exclusively in the courts of Paris, France, and that such disputes will be governed by French law, unless prohibited by the laws of the country where you reside.

9. General

Envite may update the User Agreement at any time. If we make an update that impacts either party's rights or obligations, we'll inform you about 30 days before the update takes effect. If you continue using our services after the 30 days, you're agreeing to our updated User Agreement. If you don't wish to agree, you must stop using our Services.

In the event that any part of these Terms or User Agreement is found to be unenforceable, our lawyers may worry, but all the other provisions will remain applicable.

The User Agreement is between you and Ozone Team with a registered office located at 349 Mill Point Road, South Perth, Western Australia, Australia, 6151, and registered under the ABN 64 684 537 404 owned solely by Harry Carpenter.
